Under the Affordable Care Act, if you’re a business owner with 50 or more full-time equivalent employees, you must offer your employees health insurance. Health insurance for businesses with 1–100 employees is also referred to as small business health insurance or small group health insurance.

What Is the Employer Mandate?

The Employer Mandate, officially known as The Employer Shared Responsibility Provision of the Affordable Care Act, specifies that employers with 50 or more full-time equivalent employees must offer health insurance to their employees or face fines. Coverage must be extended to dependents up to age 26, but coverage does not have to be offered to spouses.

Small businesses with fewer than 50 full-time equivalent employees do not have to offer their employees health insurance.
